Lucky Lemon, including trade name OGSM.com, (hereafter referred as ‘Lucky Lemon | OGSM’) is committed to protecting the privacy and security of your personal data. This privacy statement describes how we manage (personal) data we collect and explains how that information is used, maintained, shared and protected.

1. Personal data we collect about you

We collect personal data from you, for example:

● If you use our services, we ask for your name, contact information etc. in order to perform our contract.

● If you contact us with a question or request, we ask for your name, email address etc. We will use this information to contact you about your question or comment.

● If you apply for a job or other staffing opportunity through this website, you will be asked to submit your resume and as well as other contact information such as your email address, phone number and mailing address. We will use this information to consider you for the job opening that you specify and may also use this information to contact you regarding other staffing opportunities.

● We may use a third party service provider to assist us with some parts of our business. Our service provider will receive your information on our behalf and will not be permitted to use it for any other purpose.

2. The use of your personal data

We can only use your personal data if we have a proper reason for doing so. According to the law, we can only use your data for one or more of these reasons:

● To perform a contract with you (see the first two examples above), or
● If we have a legal duty to use your data for a particular reason, or

● When it is in our legitimate interests (this applies for example to the marketing of our products and services, our interest in better understanding our markets and in managing and further developing our company and securing our website), and:

● When you consent to it (for example if you contact us with a question or request or if you accept to be contacted regarding other staffing opportunities).

We endeavor to collect only such information that is reasonably necessary. You are responsible for ensuring that the information you provide is accurate, complete and current; we will take reasonable steps to ensure that the information we collect and use is relevant to its intended use.

If you use our, the provision of personal data is a contractual requirement, or a requirement necessary to enter into a contract. In the other circumstances (such as contacting us with a question or request and if you apply for a job or other staffing opportunity through our website), we cannot adequately help you if you do not provide the requested personal data.

Lucky Lemon | OGSM does not intended to collect or maintain personally data from persons under 16 years old. If Lucky Lemon | OGSM learns that personally identifiable information of a person under 16 years old has been collected without verifiable parental consent, then Lucky Lemon | OGSM will take the appropriate steps to delete such information.

3. Sharing of your personal data

Lucky Lemon | OGSM does not share your personal data with third parties outside of its organization, unless this is necessary to provide our services, to conduct our business operations (e.g. hosting our website or to collaborate with our business partners) or whenever we are obliged to do so by law or by a court decision. Whenever we need to transfer personal information from the European Economic Area to other countries in which applicable laws do not offer the same level of data privacy protection as in your home country, we take measures to provide an appropriate level of data privacy protection. Lucky Lemon | OGSM  highly values properly securing your personal data. For this purpose, we have implemented appropriate technical and organizational security measures. These include securing and hardening of our servers, use of firewalls, and concluding data processing agreements with third parties who host our website and through which we send our e-mails etc. Our information security policies and procedures are closely aligned with widely accepted international standards and are reviewed regularly and updated as necessary to meet our business needs, changes in technology, and regulatory requirements.

5. How long we will keep your personal data

We will retain your personal information for as long as is needed to fulfill the purposes outlined in this privacy statement, unless a longer retention period is required by law (for example, to comply with applicable legal, tax or accounting requirements). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

7. Your privacy rights and our contact information

You have the following rights:

1. The right to access information

At any point you can contact us to request the information we hold on you. Once we have received your request we aim to respond within one month and otherwise we will notify you accordingly. There are no fees or charges for the first request but additional requests for the same data may be subject to an administrative fee.

2. The right to correct and update the information

If the data we hold on you is out of date, incomplete or incorrect, you can request us to update your personal data.

3. The right to have your information erased

If you feel that we should no longer be using your data or that we are illegally using your data, you can request that we erase the data we hold. When we receive your request we will confirm whether the data has been deleted or the reason why it cannot be deleted (for example because we need it for our legitimate interests or regulatory purpose(s).

4. Restriction of processing

In certain cases you can restrict the processing of your data, for instance if you feel that the data we process is incorrect, you do not want us to erase your data but restrict the processing.

5. Withdrawal of given consent

When we process your personal data based on your consent, you have the right to withdraw this at any time.

6. The right to data portability

If you want us to move your data to another data controller, you can do this in the circumstances that you have provided the data directly to us yourself, this data is processed based on your consent or used in order to fulfil a contract and the data is automated. This right does not apply to paper records.

7. The right to object to the use of your personal information

You can object to processing of your personal data carried out by Lucky Lemon | OGSM  (including profiling) if this is processed in our legitimate interests, to carry out a task in the public interest or in the exercise of official authority, unless we have legitimate grounds to do so. In the case of direct marketing you can always object to this processing. This applies also to the situation when your data is processed for scientific, historical or statistical research purposes, unless this is necessary for the public interest. Objecting to the processing when decisions are made on an automated basis is possible, unless this is necessary for the performance or entering into our contract, this is authorized by law or when you have given us your consent.

8. Right to lodge a complaint with the Data Protection Authority

If you feel that we have not dealt correctly with your personal data, you can lodge a complaint with the Autoriteit Persoonsgegevens, the Dutch Data Protection Authority (Postbus 93374, 2509 AJ Den Haag).
